Release and Waiver Form for Sea Trial

We are excited you are sea-trialing a WorldCat catamaran. This will allow you to experience firsthand the boat’s handling characteristics and its range of capabilities on the water.

We want to have a clear understanding with you about what to expect while on the boat, and this document also forms an agreement between you, the boat’s builder, HC Composites, LLC, as well as its agents and dealers, any manufacturer of the component parts of the boat (engines, electronics, etc.), their underwriters, and their employees, including the captain and other people who help run the boat with you today (collectively, “WorldCat”). This agreement between you and WorldCat releases claims, waives rights to bring a lawsuit, and protects WorldCat from the cost of defending a lawsuit in the future if one were to be filed by you or on your behalf. . This agreement waives claims you can make against WorldCat for negligence in the design, construction, or operation of the boat, products liability or strict liability.

The boat will be operated on open water. In the event of an emergency, you may be required to leave the boat, swim and/or float until assistance arrives. The boat will be operated at both slow and high speeds, and could encounter waves from nature and other boats, wind, rain, hail, and lightning as well as floating, submerged or partially submerged objects. You understand the deck can become wet and slippery. You are allowing the operator of the boat to utilize its full range of speed and to engage in its full steering, trim, forward and backing propulsion capabilities. This operation could cause the boat to change angles, move suddenly or tilt to a steep angle. It may come to sudden stops or make a hard landing off waves, and it is possible any of thiscould throw you off balance and result in a fall to the deck or into the water. You accept that a boat being operated in this manner is reasonable and customary and is not negligent for the purposes of this sea trial.

You understand there could be airborne objects such as fish, birds, insects, drones, or windblown debris that could impact your body while the boat is being operated.

You understand the boat carries gasoline for propulsion and has other combustible liquids associated with the operation of the engines and generator, and there is a risk you could encounter a fire during a sea trial.

You are over the age of eighteen (18) and have provided a valid ID before the sea trial and are competent to enter into this agreement. If you are signing on behalf of a minor, you are doing so as the parent, custodian, or legal guardian of the minor and we can rely on your authority.

For this sea trial you agree to waive, release, defend and indemnify WorldCat (as defined above) from any claims of personal injury (physical or psychological), disability or death, as well as any costs for medical expenses, wage loss or any other claim for compensation or loss arising out of or related to the operation of this boat during this sea trial. You agree that you are waiving the right to bring suit, and you agree to pay all reasonable expenses of WorldCat in the event that someone brings suit on your behalf in violation of this agreement. You understand and acknowledge that the description of risks in this document is not complete, and that there are many other similar risks that could occur during this sea trial, and you are agreeing to release WorldCat from liability that could arise from performance of the sea trial. You agree that the consideration for this agreement is the grant of access aboard the boat, your ability to participate in the sea trial, and your ability to understand and observe the operational characteristics of the boat under a variety of conditions on the water. In the event that you directly cause damage to the boat, its crew, or third parties while present aboard the boat or while operating the boat, you agree to be responsible for the damages resulting from same but only to the extent that you are found to be negligent. The foregoing notwithstanding, you understand that WorldCat is being released for any of the claims included in this agreement . . Finally, you acknowledge that you are entering into a maritime contract subject to the general maritime laws of the United States, and that any disputes or claims arising in connection with the sea trial and this agreement shall be brought in a United States District Court having personal jurisdiction for a non-jury proceeding under the Court’s admiralty subject matter jurisdiction.
